It ranges broadly in its complexity and goals.Estate planning may consist only of specific beneficiary designation changes and a simple will or it may include tax-planned wills and any variety of trusts. Elder law attorneys are uniquely positioned for estate planning as we can also speak to and plan for long term care needs. Failing to effectively plan for long term care is the number one challenge to effectively transferring wealth to the next generation. In addition, no estate plan is complete without documents such as durable powers of attorney, healthcare powers of attorney, and advance directives, all of which are critical during one’s lifetime to ensure one’s affairs can be handled in the event of physical or mental incapacity.
