The Estate and the Person

In guardianship, the phrase, “the estate” refers to all of the assets and liabilities of a person who is subject to guardianship proceedings.  The phrase, “the person” refers to the physical body of the person subject to guardianship proceedings.  For example, a guardian of the estate can determine who to write a check to from the funds of the ward.  A guardian of the person can decide where a person will live, what medical care they will receive, whether they can marry and other similar personal decisions.
